A. Definitions: For the purposes of this section, the following definition shall apply:
BEER KEG: A reusable container holding eight hundred forty (840) ounces or more of beer or other similar alcoholic beverage.
B. Identification Tag: Any licensee who sells a beer keg shall affix to each keg sold a tag, furnished by the city of Des Plaines liquor control commissioner, containing an identification number enabling the purchaser to be identified in accordance with subsection C of this section.
C. Record Kept: The licensee shall keep a logbook of all kegs sold, showing the identification number on the tag affixed to each keg, and the purchaser's name, address, telephone number, driver's license/state identification number, date of birth, and signature. The logbook shall be available for inspection by the liquor control commissioner or the Des Plaines police department.
D. Deposits:
1. The licensee shall require the purchaser to deposit, at the time of the sale of a keg, at least seventy dollars ($70.00) for sale of a keg with pumper and at least twenty dollars ($20.00) for sale of a keg without a pumper. The deposit shall be refunded only upon the return of the keg with the tag properly affixed. Only one deposit fee will be required from a purchaser of more than one keg at any one time.
2. The licensee shall require the purchaser, at the time of the sale, to sign a form to be provided by the liquor control commissioner, setting forth the provisions of this section and informing the purchaser that the deposit will be forfeited if the keg is not returned with the tag properly affixed. The licensee shall retain this form for ninety (90) days after the sale.
3. Any keg not returned with the tag properly affixed within sixty (60) days following the date of sale shall be considered lost, and the deposit shall be forfeited. The licensee shall notify the city of Des Plaines liquor control commissioner on a monthly basis of all deposits that are forfeited. (Ord. M-19-13, 10-7-2013)
