3-6-2: DIRECTOR OF PUBLIC WORKS AND ENGINEERING:
   A.   Office Established And Appointment: There is hereby established the office of the director of public works and engineering. The director of public works and engineering shall be a competent civil engineer and registered as a professional engineer by the state. The director of public works and engineering shall be appointed by the city manager. Political considerations shall not be used by the city manager in the selection or removal of the director of public works and engineering.
   B.   Powers And Duties: The duties of the director of public works and engineering shall include, but are not limited to, the following:
      1.   Prepare or superintend the preparation of plans, specifications and contract documents for public improvements within the jurisdiction of the city council and the board of local improvements.
      2.   Be in charge of the inspection, field engineering and surveying required for public improvements of the city.
      3.   Be in charge of all surveys required by the city, together with the preparation of all maps, plats and charts required for public improvements or the official records of the city.
      4.   Prepare or superintend the preparation of all profiles, the taking of all levels and the establishment of all grades for public improvements, including the establishment of street and sidewalk grades for the city.
      5.   Be the official engineer of the city council and city manager and superintend and supervise all public improvements and work that is directed to be performed by the city council and/or the city manager.
      6.   Assist the city attorney in the preparation, drafting and drawing of all ordinances, resolutions and contracts for all public, semipublic or special work and in all litigation regarding public improvements or in matters of which the city may be interested, rendering such assistance as may be required.
      7.   Conduct such investigations, inspections, analyses and reports, and perform such duties as may be required by the city council and city manager in connection with rights of way, traffic, transportation and utility franchises, buildings and structures or other public infrastructure functions of the city.
      8.   Execute on behalf of the city all grants of easement (temporary and permanent) that are necessary for the furtherance of public improvement projects overseen by the department of public works and engineering.
      9.   Ensure the inspection of all connections made to the sewer system and the water supply system of the city.
      10.   Be in charge of all repairs to and maintenance of public improvements and public works.
      11.   Regulate and control the manner of using the streets, alleys, highways, easements and other places of the city for the erection of utility poles or other poles and posts.
      12.   Regulate and control the laying of pipes, conduits or sewers authorized by law or the city.
      13.   Determine the location thereof and cause the prompt repair of streets, alleys, highways and public places when the same are taken up or altered; provided, however, that the abatement and removal of all nuisances affecting health shall be in the special charge and control of the city sanitarian.
      14.   The director of public works and engineering shall be the head of the department of public works and engineering and shall have supervision over all employees of the department and shall be responsible for the performance of their duties.
   C.   Enforce Regulations: It shall be the duty of the director of public works and engineering to enforce all regulations of this or any other code of the city relating to the water or sewer system and to perform such other duties as may be required by enactment of the city council. Upon violation of any provision of this or any other code, the director of public works and engineering shall make a complaint before the proper court against all persons found to have violated any such provisions.
   D.   Reports: The director of public works and engineering shall, when required by the city council or city manager, inquire into and report upon any matter pertaining to public works or engineering, and shall, from time to time, communicate to the city council and city manager any information or suggestion which may be deemed important in relation thereto. The director of public works and engineering shall, when required by the city council or city manager, report verbally or in writing to them on all matters under the jurisdiction of the director.
