8-5-1: FRANCHISE ORDINANCE REQUIREMENT:

A. Granting Franchise: Under chapter 3, article 42 of the New Mexico Statutes Annotated 1978 a municipality may grant, by ordinance, a franchise to any person, firm, or corporation for the construction and operation of any public utility.

B. Requirement: It shall be unlawful for any public utility to operate within the city limits without a current franchise ordinance in place. (Ord. 1077, 7-14-2003)
