(1) Any vehicle propelled or intended to be propelled by power other than human power and which is in an inoperative or partially dismantled condition. Portions of junk motor vehicles, such as hoods, fenders, radiators, rims, motors, and the like not being utilized for the repair of a motor vehicle shall be considered as junk.
(2) Any trailer.
(b) For the purposes of the above definition, the following definitions shall apply:
(1) “Inoperative condition.” A vehicle, as above described, which is incapable of being propelled under its own power; has no value except for salvage or junk purposes; has not been licensed and issued an appropriate number and registration mark valid for the current year, where required pursuant to Ohio R.C. Chapter 4503; or which does not display such distinctive number or registration mark.
(2) “Partially dismantled condition.” A vehicle as above described that has some part or parts missing which is or are ordinarily an essential component thereof.
(c) No person in charge or control of any premises within the Village whether as owner, tenant, lessee, occupant, or otherwise shall allow any junk motor vehicle or trailer to remain upon such premises outside an enclosed garage, building, or buildings. The violations thereof are declared to be a public nuisance and offensive to the public health, welfare, and safety of the citizens of the Village.
(d) The provisions of subsection (c) hereof shall not apply to the deposit, storage, maintenance, or collection of junk motor vehicles or trailers in an enclosed building, in a regularly established junkyard, or in an area of the Village in which the same shall be permitted under the regulations of the Zoning Code.
(e) The Chief of the Police Department or any member of the Department designated by him is authorized to remove or cause to be removed any junk motor vehicles or trailers remaining at any place within the Village in violation of the provisions of this section. Such junk motor vehicles or trailers shall be impounded until lawfully claimed or shall be disposed of by the Chief of Police if unclaimed for a period of fifteen days after the first day of storage in accordance with the provisions of Ohio R.C. Section 4313.60-4513.65.
(f) Whoever shall violate the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not more than one hundred dollars ($100.00) for each offense. Any such violation shall constitute a separate offense on each successive day continued.
