Whenever it becomes necessary to use Village personnel, Village equipment and/or purchase materials, as a result of the negligent, intentional or accidental act of a third party, including the repairing or restoring of Village owned property, the cutting of weeds and/or grass, or for failure to comply with Village ordinances, the Village shall charge for any and all labor performed by Village personnel, for any and all Village equipment, and/or for the purchase of materials used therefor according to the following schedule:
(a) Labor performed and equipment used during normal Village working hours:

$40.00 per hour, one hour minimum | $65.00 per hour per each piece of Village equipment used with one hour minimum. |
(b) Labor performed and equipment used during other than normal Village working hours:

$60.00 per hour, two hour minimum | $65.00 per hour per each piece of Village equipment used with one hour minimum. |
(c) All material shall be provided by the Village and shall be billed at current cost plus five percent (5%).
(d) For purposes of this section, the normal Village working hours are Monday through Friday, from 7:00 a.m. until 3:30 p.m.
