139.05 INDIGENT BURIAL POLICY.
   (a)   The City is authorized and obligated to pay burial or cremation expenses of indigent person found to be legal residents of the municipality at the time of death. Expenses for burial are limited to a maximum of eight hundred dollars ($800.00). In addition the city shall provide a stone or concrete grave marker with the person’s name, date of birth and date of death inscribed.
   (b)    Before any interment or payments are made pursuant to this section, the funeral director providing the interment shall submit to the Safety-Service Director or his/her designee:
      (1)   Proof of residency of the deceased
      (2)   Copy of death certificate
      (3)   A statement of payment being requested.
      (4)   An original or certified copy of an original certification of indigence from the next of kin, person having legal authority to represent the decease, if the aforementioned does not exist or is unwilling or unable to certify indigence, then the person most knowledgeable about the affairs of the deceased may attest to the certification of indigence.
      (5)   A certificate of indigence shall be in a form prescribed by the Safety Service Director and shall be completed, signed, and witnessed before the Clerk of Council or deputy clerk of council prior to the day of interment.
   (c)   Should it be ascertained, after the city has incurred any cost associated with an interment, that the decedent had means, assets, insurance or other benefits or allowances available for the payment of all or part of such expenses and was not subject to Ohio R.C. 5101.521, the City shall be entitled to any benefits payable on behalf of such decedent by any person or agency having responsibility to pay internment benefits, up to the total amount incurred by the City.
