1351.13 GENERAL ORDINANCE PROVISIONS.
   (a)   Nothing contained in this chapter shall be deemed to require any action to any building or parcel that at the time of this ordinance was adopted was in compliance with all applicable laws of the City of Delphos, including the Delphos Zoning Ordinances. Any future actions to buildings or lots in the Downtown Business District shall be subject to strict compliance with the provisions of this Ordinance and all other ordinances of the City of Delphos, including the then applicable Delphos Zoning Ordinances.
   (b)   If any provision, or part thereof, of these amendments to the Delphos Zoning Ordinances are deemed to be invalid for any reason, the remaining portions of these amendments shall remain fully in effect and the ordinance, as revised, shall be interpreted in a fashion that is as close to being in harmony with Ordinance prior to the date any provision is deemed partially or wholly invalid as the law will permit.
   (c)   In the event any building, structure, landscaping, plantings, fence, or other exterior visible improvement is erected, installed, constructed, reconstructed, altered, maintained, or removed contrary to and in violation of the provisions of this ordinance or any Certificate of Appropriateness granted by a Design Review Board, then, the City Council, or its agent, any other proper authority of the City, or any aggrieved person may institute injunction, mandamus, or other legal proceeding to prevent such violation, to abate any illegal conditions, or the cause the removal of any illegal structure or alterations by legal means.
   (d)   In addition to the provisions of subsection (c) above, any person, aggregation of persons, or entities of whatsoever nature of description which are recognized by Ohio Substantive Law, including, but not limited to, corporations, partnerships, limited liability companies, etc., who violate the provisions of this ordinance, shall be deemed to be in violation of the Delphos Zoning Ordinance and such violation shall be punishable as prescribed in Chapter 1143 of the Zoning Ordinance. Each day of violation shall constitute a separate and distinct violation.
   (e)   It is found and determined that all formal action of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements of the City of Delphos and the State of Ohio Revised Code §121.22.
