921.02 DEFINITIONS.
   As used in this chapter, the following words and terms shall be defined as follows:
   (1)   “Administrator” means the Administrator of the United States Environmental Protection Agency, or any person authorized to act for him.
   (1.5)   “Ammonia” (At) means biological oxidation and conversion of nitrogenous organic matter and broken down into simple compounds as identified in Standard Methods for the Examination of Water and Wastewater.
   (2)   “Carbonaceous Biochemical oxygen demand (CBOD)” means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20 degree C.
   (3)   “City” means the City of Delphos, Ohio.
   (4)   “Combined sewer” means a sewer intended to receive both wastewater and storm or surface water.
   (4.5)   “Commercial user class” means retail or wholesale business establishments that discharge wastewater into the public wastewater treatment system, works and facility.
   (5)   “Compatible pollutant” means a waste constituent which does not interfere with the operation or performance of the wastewater treatment works.
   (6)   “Consumer unit” for the purpose of computing minimum billings means a singular use of the City wastewater treatment works by an owner or person as long as that use is only beneficial to the management and operation of that owner or person’s individual housing, commercial or industrial interest and lies within the same structure or structures constituting a complex under the same management. Certain normal home occupations as allowed by the Zoning Board of Appeals and agreed upon by the Director shall be considered as a singular consumer unit. Examples of additional consumer units shall be:
      A.   Any and all additional living units; or
      B.   Any additional business or industries in the same structure or complex with totally different ownerships and managements; and
      C.   Two or more commercial or industrial units owned by the same owner or person and in the same structure or complex but with distinct different and unrelated operations, employees, management and customers, if any.
   (6.5)   “Debt service charge” means the funds used for the retirement of and interest on bonds and/or notes authorized and issued by the City of Delphos to construct sewage system facilities.
   (7)   “Director” means the Safety Service Director of the City or his designated representative.
   (8)   “Environmental Protection Agency” means the Federal Environmental Protection Agency or any person authorized to act for that agency.
   (9)   “Incompatible pollutant” means a waste constituent which interferes with the operation or performance of the wastewater treatment works.
   (10)   “Industrial user class” includes users discharging waste resulting from manufacturing activities involving the mechanical or chemical transformation of materials or substance into other products. These activities occur in establishments usually described as plants, factories, or mills and characteristically use power-driven machines and material handling equipment.
   (11)   “Industrial Waste” means any solid, liquid or gaseous substance, resulting from any industrial, manufacturing, trade or business process or from the development, recovery or processing of natural resources.
   (11.5)   “Institutional/governmental user class” includes hospitals, nursing homes, schools, city, county, state or federal buildings or facilities that discharge wastewater into the public wastewater treatment system, works or facility.
   (12)   “Intercepting sewer” means a sewer intended to receive flows from both combined sewers and sanitary sewers; or a sewer whose primary purpose is to transport wastewater from collector or local sewers to a wastewater treatment plant.
   (13)   “lb.” is an abbreviation for pound.
   (14)   “Maintenance” means upkeep and repair costs required to maintain the wastewater treatment works structures and equipment in efficient operating condition during the service life of such works.
   (15)   “May” is permissive; “shall” is mandatory.
   (15.5)   “Normal domestic sewage” means wastewater that has a CBOD concentration of not more than 200 mg/l, a suspended solids (SS) concentration of not more than 240 mg/l, and phosphorous of not more than 10 mg/l and contains no other pollutants in significant quantity.
   (16)   “NPDES” or “National Pollutant Discharge Elimination System” permit means any permit or equivalent document or requirements issued by the State water pollution control agency to regulate the discharge of pollutants from the wastewater treatment works.
   (16.5)   “Oil and grease” (Total) (Ot) means a combination constituent in wastewater such as various types of vegetable oils and animal fats; all hydrocarbon type oils and greases such as petroleum oils, cutting oils or any mineral oil origin.
   (17)   “Operation” means any physical and mechanical actions, processes or functions required to efficiently operate the wastewater treatment works as defined herein.
   (18)   “Owner”  is any person with title or rights to a property or facility.
   (18.5)   “Person” means any individual, firm, company, industry, association, society, corporation or group.
   (19)   “Phosphorus” means a constituent in wastewater as identified in Standard Methods for the Examination of Waste Water.
   (20)   “Pollutant” means any noxious chemical or other refuse material or constituent that impairs the purity of water.
   (21)   “Pretreatment” means the treatment of wastewater from sources before introduction into the wastewater treatment works.
   (22)   “Replacement” means expenditures for obtaining and installing equipment, accessories or appurtenances necessary to retain design capacity and performance of the wastewater treatment works throughout the City’s jurisdiction.
   (22.5)   “Residential user class” means a principal family residence or habitation classified as a single family, multifamily or apartment dwelling that discharges only normal domestic strength wastewater into the public wastewater treatment system, works and facility.
   (23)   “Sanitary sewer” means a sewer that carries liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with quantities of ground, storm and surface waters.
   (24)   “Sanitary sewer charges” means the aggregate of rate increments established by two separate revenue systems, i.e., user charges and extra strength surcharges.
   (24.5)   “Sewage” means water-carried human wastes or a combination of water carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface, storm or other waters as may be present.
   (25)   “Sewer” means a pipe or conduit that carries wastewater or drainage water.
   (25.5)   “Sewer service charge” means the total charge levied against users of the sewage system for sewer service. The charge shall include user charges, debt service charges, and extra strength surcharges.
   (26)   “Storm sewer” means a sewer for conveying storm water, ground water, subsurface water or unpolluted water from any source.
   (27)   “Suspended solids” means total suspended matter that either floats on the surface of, or is in suspension in, water, wastewater or other liquids, and that is removable by laboratory filtering as prescribed in Standard Methods for the Examination of Water and Wastewater and referred to as nonfilterable residue.
   (28)   “User charge” means a charge levied on users of the wastewater treatment works for the cost of operation and maintenance of such works.
   (29)   “User class” means any class of users of the wastewater works, as defined in Section 921.06.
   (30)   “Wastewater” or “wastes” means the spent water of a community. From the standpoint of source, it may be a combination of the liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with any groundwater, surface water and stormwater that may be present.
   (31)   “Wastewater treatment plant” or “plant” means that portion of the wastewater treatment works required to treat wastewater and dispose of the effluent.
   (32)   “Wastewater treatment works” or “works” means the structures, equipment, parcels of land, easements and processes required to collect, carry away and treat wastewater and dispose of the effluent of the City. Wastewater treatment works includes sanitary sewers and intercepting sewers, but does not include storm sewers.
