§ 155.10  NUISANCE AND INJUNCTION.
   The Village Clerk shall cause to be served a notice in writing, either by personal service or by certified mail, return receipt requested, upon any person, individual, municipal corporation, or other entity, who has authorized the drilling of a well, is drilling a well, or is operating and pumping a well within the territory of a ten mile radius of the corporate limits of the village without a permit, requiring him or her to abate the same within ten days from the receipt of said notice, in such manner as the notice shall direct. If the person so served and notified does not abate the said drilling, or operation and pumping, of the well within the specified time, said action by the person, individual, municipal corporation, or other entity shall be deemed a nuisance subject to abatement. The Village Board, by resolution, may proceed to abate the nuisance in any or all manner allowable by law, including, without limiting the generality thereof, the seeking to enjoin the continuation of the nuisance by filing a lawsuit in a court of competent jurisdiction.
