For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ABANDONMENT. Deemed to have taken effect when a well shall not have been pumped for 1,000 consecutive days.
ANY PERSON, FIRM, CORPORATION, MUNICIPALITY, OR OTHER ENTITY. Or any parties thereof; any owner of the land, or the owner’s designated agent, including any individual, partnership, firm, association, joint venture, corporation, trust, estate, commission, board, public or private institution, unit of local government, school district, conservation district, any interstate body, or any other legal entity, or any person, firm, corporation, or other entity leasing the ground upon which the point of withdrawal is located within the village’s zone of protection.
DRILLING. Actual drilling, setting of any pumps, testing of such well, and actual operation of said well.
POINT OF WITHDRAWAL. The point at which underground water is diverted by a person from its natural state.
REASONABLE USE. The use of water to natural wants and a fair share of artificial wants. It does not include water used wastefully or maliciously.
WELL. Any well which shall be used for the production of gas, oil, injection or water.
ZONE OF PROTECTION. The geographical area which lies within ten miles in any direction of the village corporate limits.
