§ 2.08.010 OFFICERS AND TERMS OF OFFICE.
   In accordance with MCA § 7-4-4102, the officers of the city will consist of:
   (A)   One Mayor elected to serve for a period of four years;
   (B)   Two City Council members from each ward elected for four years;
   (C)   In accordance with MCA § 3-10-101, the City Council may combine the offices of City Judge and the Justice of the Peace. Furthermore, in accordance with MCA § 3-11-205, the City Council may enter into an agreement with the county to designate the Justice of the Peace to serve as the City Judge. The Justice of the Peace or City Judge must reside in the county. The City Council may, by ordinance fix the funding for the City Judge and enter into an agreement with the county, or the Justice of the Peace for payment of salaries and training expenses. The Justice of the Peace shall, after agreeing to the designation and after approval by the Board of County Commissioners or the City Council, act in that capacity and is the City Judge in all cases arising out of violations of statutes or ordinances. If the Justice of the Peace or City Judge of another city or town is required to travel from the justice’s or judge’s place of residence to hold court, the justice or judge must be paid the actual and necessary travel expenses, as provided in MCA §§ 2-18-501 through 2-18-503, by the town or city in which the court is held;
   (D)   There may also be appointed by the Mayor, with the advice and consent of the City Council:
      (1)   One Chief Administrative Officer;
      (2)   One City Attorney;
      (3)   One City Clerk, who is ex-officio City Assessor;
      (4)   One City Treasurer or one City Clerk/Treasurer (as referenced by the MCA, however in the city, the City Clerk and City Treasurer are two separate entities);
      (5)   One Chief of Police;
      (6)   One Fire Chief;
      (7)   One Public Works Superintendent;
      (8)   One Animal Control Warden (may be combined with Code Enforcement Officer);
      (9)   One Code Enforcement Officer (may be combined with Animal Control Warden); and
      (10)   Any other officers necessary to carry out the provisions of this title.
   (E)   The City Council may prescribe the duties of all city officers and fix their compensation.
