(A) Actions for the violation of any law of the municipality must be commenced in one of the following methods:
(1) First: when the offense is committed in the presence of the Chief of Police or any police officer, he or she may arrest the offender without a warrant and bring him or her forthwith before the City Judge; and
(2) Second: in all other cases, a complaint must be filed and verified by the party making the same, which shall contain the name of the party to be arrested, if known, and if not known, the complaint may designate him or her by any other name.
(B) The complaint shall also contain a brief statement of the acts constituting the offense for which the person is arrested, with the date of the offense, if known and reference to the title of the chapter or ordinance, number and section thereof, he or she is charged with violating.
