§ 50.05  PERMITS, REGISTRATION, INSPECTIONS AND FEES.
   (A)   Before commencement of installation of any private on-site wastewater treatment system or privy or where any alteration, repair or addition of an existing private on-site wastewater treatment system or privy is planned, the owner or agent of the owner shall first obtain a written septic construction permit signed by the Health Officer. The application for such permit shall be made on a form provided by the County Health Department. The application shall be accompanied by any plans, specifications and other information as may be deemed necessary by the County Health Officer.
   (B)   A fee of $50 shall be assessed for obtaining a septic system construction permit for new residential construction. A fee of $50 shall be assessed for renewal of a septic system construction permit for new residential construction.
   (C)   A fee of $50 shall be assessed for obtaining a septic system construction permit for new commercial construction. A fee of $50 shall be assessed for renewal of a septic system construction permit for new commercial construction.
   (D)   Any construction permit issued under this chapter shall not be sold, assigned, loaned or transferred.
   (E)   A preconstruction review with the on-site wastewater treatment system installer may be required for all installations.
   (F)   A final permit for a private on-site wastewater treatment system or privy shall not become effective until the installation is completed to the satisfaction of the County Health Officer. He or she or his or her agent shall be allowed to inspect the work at any stage of construction; and, in any event, the applicant for the permit shall notify the County Health Officer when the work is ready for final inspection, and before any underground portions are covered. The inspection shall be made within two working days of the receipt of notice by the County Health Officer.
   (G)   For new construction only, the septic system must be installed and inspected prior to building
or placing tire dwelling on the property. Waivers will be granted on a case by case basis only by the Health Officer or the Health Officer’s designee.
   (H)   If the on-site wastewater treatment system or privy has not been constructed within two years from the date of issuance for a new installation or within six months from the date of issuance for a repair, the permit shall expire unless an extension is warranted by the Health Officer.
   (I)   The Health Officer or his or her duly appointed agent shall have authority to inspect any and all private on-site wastewater treatment systems or privies here-to-for installed and existing at the passage of this chapter. If at such inspection it would appear to the Health Officer that any such sewage disposal system or privy is unsanitary he or she shall notify the owner of the real estate upon which said system or privy is located, or the agent of such owner, of said finding and shall order said owner or agent to make whatsoever change as may be necessary to correct such unsanitary condition.
   (J)   All fees collected under the terms of this chapter shall be receipted monthly into the County Health Fund (0801 Fund) for services in enforcing this chapter.
