(A) (1) The County Council hereby establishes the County Enhanced Access Fund. Fees collected under this section for providing enhanced access to public records shall be deposited into this fund.
(2) Money in the Enhanced Access Fund shall be administered by the GIS coordinator. Any fees collected pursuant to a contract for enhanced access to the public records of the county shall be deposited into this fund. Money in this fund shall be appropriated as approved by the County Council and may be used for the replacement, improvement and expansion of capital expenditures, or the reimbursement of operating expenses incurred in providing the enhanced access.
(B) Any office of the county is authorized to charge the following fees for providing a printed map:

(C) For the production of a printed map which requires the GIS Manager or the manager’s designee to assemble data sets or complete specific analysis requests, a fee is established of $25 per hour, to be billed in increments of one-quarter hour with a minimum fee of $6.25. This fee is in addition to the fee for the printed map.
(D) Payment for information under this section shall be made at time of delivery, or if access has been granted by contract, under the terms of the contract. A person requesting information to be provided by mail must pay all postage or shipping costs.
(E) (1) A person who receives information from the public records of the county through enhanced access may not use the information for commercial purposes/including to sell, advertise or solicit the purchase of merchandise, goods or services, or sell, loan, give away or otherwise deliver the information to any other person for these purposes.
(2) A person who uses information in a manner contrary to this section may be prohibited from obtaining any further data.
(F) In the event the fees or other provisions of this section are in conflict with state law, the state law shall apply.
