For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ABANDONMENT. Shall be presumed to occur when a segment has been abandoned pursuant to the Interstate Commerce Commission Termination Act or successor statutes and at least 100 continuous feet of rail has been removed without immediate replacement.
OWNER. Shall not include the holder, as such, of any reversionary interest in the railroad right-of-way, but shall include each holder of any present or future interest in the rail, ties or other track material located thereon.
