(A) This section is to clarify and establish an uniform video franchise fee to be paid by all current and future holders of video franchise certificates issued by the Indiana Utilities Regulatory Commission which authorize providing video services within the city.
(B) A 3% video franchise fee shall be paid, in the manner and as determined pursuant to I.C. 8-1-34, to the city by a holder of a franchise certificate issued by the Indiana Utilities Regulatory Commission which authorizes the holder to provide video services to customers within the city limits.
(C) Nothing shall be construed to relieve holders of franchise certificates issued by the Indiana Utilities Regulatory Commission from paying a 3% franchise fee to the city for quarterly periods such holders provided video services within the city prior to the effective date of this section, as such holders were obligated to pay a 3% fee prior to this section by virtue of the sole franchise agreement existing on July 1, 2006.
