§ 33.160 ESTABLISHED.
   (A)   Purpose. The purposes of this subchapter are to establish a special, non-reverting fund to be known as the ARP Coronavirus Local Fiscal Recovery Fund and to establish permitted uses of ARP revenues deposited into such fund.
   (B)   Fund. There is hereby established and created a special, non-reverting fund designated as the ARP Coronavirus Local Fiscal Recovery Fund. ARP monies deposited into this fund may not be transferred to another fund of the city. The fund shall remain in existence until terminated by ordinance of the Common Council.
   (C)   Deposit of ARP distributions. The source of funds to be deposited into the ARP Coronavirus Local Fiscal Recovery Fund, and the only source of funds to be deposited into the fund, are ARP federal assistance funds which are to be distributed to the city in 2021 and 2022.
   (D)   Use of funds. ARP monies distributed to the city and deposited into the fund may only be utilized for the following purposes:
      (1)   To respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19) or its negative economic impacts, including assistance to households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality;
      (2)   To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers of the city that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;
      (3)   For the provision of government services to the extent of the reduction in revenue of the city due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year of the city prior to the emergency, namely, the year 2019;
      (4)   To make necessary investments in water, sewer, or broadband infrastructure; and
      (5)   To be used for such other purposes, if any, as may be permitted under ARP.
   (E)   Detailed plan for use of ARP funds. The Common Council shall develop and adopt a plan which provides details for the use of ARP funds. Use of ARP funds shall be consistent with the detailed plan developed and adopted by the Common Council.
   (F)   Disbursement of ARP funds. Disbursement of ARP funds deposited into the fund may not occur until monies have been appropriated by the Common Council, either as budgeted or by an additional appropriation, and disbursement may not occur unless a claim for payment is submitted to and approved by the Common Council pursuant to the normal claims process.
