ORDINANCE 2020-1
SHORT TITLE:   AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF DECATUR, INDIANA WHICH ENACTS AND ADOPTS S-4 SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF DECATUR, INDIANA, AND WHICH DECLARES AN EMERGENCY REGARDING THE EFFECTIVE DATE OF SUCH SUPPLEMENT
   WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio, has completed the 2019 S-4 Supplement to the Decatur Code of Ordinances of 2015, which Supplement contains all ordinances of a general and permanent nature enacted since the adoption of the Decatur Code of Ordinances of 2015 as supplemented in 2016, 2017, 2018 and 2019; and
   WHEREAS, American Legal Publishing Corporation has recommended the revision or addition of certain sections of the Decatur Code of Ordinances of 2015 which are based on or make reference to sections of the Indiana Code; and
   WHEREAS, it is the intent of the Common Council of the City of Decatur, Indiana, which is the legislative body of the City of Decatur, to accept these updated sections in accordance with the changes of the law of the State of Indiana; and
   WHEREAS, it is necessary to provide for the usual daily operation of the City of Decatur, Indiana, and it is necessary for the immediate preservation of the public peace, health, safety and general welfare of the citizens of the City of Decatur, Indiana, that this ordinance take effect at the earliest possible date;
   NOW, THEREFORE, BE ORDAINED BY THE COMMON COUNCIL OF THE CITY OF DECATUR, INDIANA, AS FOLLOWS:
   Section 1.   Purpose. The purpose of this Ordinance is to amend the Decatur Code of Ordinances of 2015, as supplemented by the 2016 S-l, 2017 S-2, and 2018 S-3 Supplements.
   Section 2.   2019 S-4 Supplement. The 2019 S-4 Supplement to the Decatur Code of Ordinances of 2015 as submitted by American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto, be and the same is hereby adopted by reference as if set out in its entirety.
   Section 3.   Publication of Supplement. Such Supplement shall be deemed published as of the day of its adoption and approval by the Common Council of the City of Decatur, Indiana, and the Decatur Clerk-Treasurer is hereby authorized and ordered to insert such supplement into the copy of the Decatur Code of Ordinances of 2015 kept on file in the Office of the Clerk-Treasurer and to cause such supplement to be inserted into the copy of the Decatur Code of Ordinances of 2015 which is published online at the official website of the City of Decatur, Indiana.
   Section 4.   Effect of Ordinance. This Ordinance shall amend the Decatur Code of Ordinances of 2015, as supplemented in the 2016 S-l, 2017 S-2, and 2018 S-3 Supplements. Provisions of said Code which are in conflict with the provisions of the 2019 S-4 Supplement adopted herein, if any, shall be deemed repealed and superseded by the provisions of the 2019 S-4 Supplement. Unless otherwise amended herein, all other provisions of the Decatur Code of Ordinances of 2015, as supplemented in the 2016 S-l, 2017 S-2, 2018 S-3 Supplements, shall remain in full force and effect.
   Section 5.   Effective Date. This Ordinance is declared to be an emergency measure necessary for the immediate preservation of the peace, health, safety and general welfare of the people of the City of Decatur, Indiana, and shall take effect at the earliest date provided by law.
   ALL OF WHICH IS DULY PASSED, ADOPTED AND ORDAINED BY THE COMMON COUNCIL OF THE CITY OF DECATUR, INDIANA, ON THIS 18TH DAY FEBRUARY, 2020.
