6.04.080: IMPOUNDMENT; NOTICE TO OWNER; CHARGES:
   A.   Not later than two (2) days after the impounding of the dog, the Chief of Police of the City shall cause a written notice of such impounding to be posted in a conspicuous place in the Office of the Clerk of the City and to be posted in one other conspicuous public place within the City. Such notice shall be kept posted for a period of five (5) full days.
   B.   If the name and address of the owner of the dog is known to the Chief of Police of the City, he shall also mail a copy of the notice to the owner of the dog at the address of such owner known to the Chief of Police within two (2) days after the impounding of the dog, or instead of mailing such notice to the owner, the Chief of Police may, if he knows the name and address of the owner of the dog, deliver a copy of the notice to the owner of the dog within two (2) days after the impounding of the dog. The delivery of a copy of the notice to a person over the age of eighteen (18) years of age at the place of abode or of business of the owner of the dog shall be considered and deemed to be delivery of such notice to the owner of the dog.
   C.   If the owner of the dog has knowledge of the impounding of the dog, the Chief of Police of the City shall not be required to mail or deliver a copy of the notice to the owner of the dog, but may do so, but shall in all cases comply with the posting provisions set forth in this section.
   D.   The owner of the dog so impounded may reclaim such dog upon the payment of the license fee if unpaid, and all the following costs and charges for impounding and keeping the dog:
      1.   For impounding the dog the sum of twenty five dollars ($25.00).
      2.   For keeping the dog the sum of three dollars fifty cents ($3.50) per day or part thereof, and such other and further amounts as are charged to the City of Deary for keeping the dog; and
      3.   For giving notice of the impounding the sum of two dollars fifty cents ($2.50).
   E.   The impounding charge shall be doubled each time that any particular dog is impounded. (Ord. 250 § 1, 1982: Ord. 180 § 3, 1968)
