16.04.030: PRELIMINARY PLAT:
   A.   Preapplication:
      1.   Sketch Plan: Prior to the filing of an application for approval of the preliminary plat the subdivider shall submit three (3) copies of a sketch plan to the commission. The sketch plan shall include the entire developmental scheme of the proposed subdivision, in schematic form and include the area proposed for immediate development in such a form and content as required by the Council and shall include the following:
         a.   The general layout of streets, blocks and lots in sketch form;
         b.   The existing conditions and characteristics of the land on or adjacent to the proposed subdivision site; and
         c.   Areas set aside for schools, parks and other public facilities.
      2.   Fee: A fee shall be paid at the time of preapplication as set by resolution of the City Council.
      3.   Commission Action: The subdivider shall submit the preapplication to the City ten (10) days prior to the regular meeting. At the regular meeting the subdivider shall present his preapplication and intent to the commission for review and comment. The commission may, if it deems necessary, request review of the preapplication by other agencies. The commission will review the preapplication to determine its compliance with this chapter as well as the following concerns:
         a.   The compliance of the proposed development with existing local or State policies, goals and objectives or development plans;
         b.   Determination of additional special permits or ordinance conflicts such as rezoning, conditional use permit or variance that may be needed and the determination of the manner that such requirements can be combined into one permit;
         c.   Advise the applicant of any unique environmental or hazardous concerns that may be directly or indirectly associated with the subject property, such as areas that have been designated by the State as areas of critical environmental concern, unique plant or animal life, floodplain, airport flight pattern and the like; and
         d.   Provide the subdivider with all necessary forms.
   B.   Preliminary Plat: The subdivider shall file with the City copies of the completed subdivision application form as prescribed and copies of the preliminary plat with supporting data as required in this section.
      1.   Form Of Presentation: The information hereinafter required as part of the preliminary submittal shall be shown graphically or by note on plans, or by letter, and may comprise several sheets showing various elements or required data. All mapped data for the same plat shall be drawn at the same standard engineering scale, having a minimum scale of no more than one hundred feet equals one inch (100' = 1"). Drawings shall not exceed twenty four inches by thirty six inches (24" x 36") in overall dimensions.
      2.   The Contents Of Map: preliminary plat map prepared by the subdivider and filed with the City shall contain the following:
         a.   Proposed name of subdivision and its location by section, township and range; reference by dimension and bearing to a section corner or quarter section corner.
         b.   Name, address and phone number of subdivider and engineer, surveyor, landscape architect or land planner preparing the plat.
         c.   Scale, north point and date of preparation including dates of any subsequent revisions.
         d.   Vicinity map drawn to a scale of one inch equals six hundred feet (1" = 600'), clearly showing proposed subdivision configuration in relationship to adjacent subdivisions, main arterial routes, collector streets, etc.
         e.   Topography shown in the same map as the proposed subdivision layout. Contour interval shall reflect the character and drainage of the land.
         f.   Location of water wells, streams, canals, irrigation laterals, private ditches, washes, lakes or other water features; direction of flow; location and extent of known areas subject to inundation.
         g.   The approximate location of existing sanitary sewers, storm drains and water supply mains within the tract and immediately adjacent thereto.
         h.   The location, widths and other pertinent dimensions of existing or platted streets and other important features such as railroad lines, watercourses, easements of public record, permanent structures to remain and exceptional topography within and contiguous to the tract to be subdivided.
         i.   Boundaries of the tract to be subdivided shall show approximate dimensions and acreage.
         j.   Name, book and page number or document or plat number of any recorded adjacent subdivision having a common boundary with the tract.
         k.   The location, widths and other pertinent dimensions of proposed streets, alleys, pedestrianways, sidewalks, easements, rights-of-way, parks and other open spaces.
         l.   All parcels of land intended to be dedicated for public or reserved for the use of all property owners with the purpose indicated.
         m.   Typical lot dimensions to scale; approximate dimensions of all corner lots and lots of curvilinear sections of streets; proposed lot and block numbers, total number of lots.
         n.   The proposed names of all the streets whether new or continuous.
         o.   By note, the existing zoning classification of the tract and any requested zoning changes.
         p.   Appropriate information that sufficiently details the proposed development within any special development area, such as hillside, planned unit development, floodplain, cemetery, mobile home, large-scale development, hazardous and unique areas of development.
         q.   A statement describing the proposed irrigation system shall appear on the preliminary plat.
         r.   The proposed method of handling sanitary sewage, stormwater, irrigation and potable water within the tract and any off-site improvements if required.
   C.   Additional Information: The preliminary plat map submittal shall be accompanied by the following information which may be on separate sheets or in letter form:
      1.   If the proposed subdivision is part of a larger area intended for development, a Development Master Plan of the entire area.
      2.   Such evidence and data of calculations shall be furnished which may be required by the City to evaluate the proposed facilities or their impact upon existing facilities.
      3.   When individual sewage disposal systems are proposed, a feasibility study shall be furnished.
      4.   Appropriate information to justify the approval of any lots designed according to the provisions of this chapter.
   D.   Review: The subdivider shall transmit a copy of the application to such other agencies as listed by the City that have jurisdiction or an interest in the proposed subdivision for their review and recommendations. Such transmittal shall require proof of service to be submitted to the City. If no reply is received within twenty (20) calendar days from the date of notification, approval of the preliminary plat by such department or agency will be considered to be granted.
   E.   City Action: Ten (10) calendar days following receipts of the preliminary plat and all other required data, said preliminary plat shall be placed on the agenda for the consideration at the next regular meeting of the commission. The subdivider shall be responsible to notify all affected property owners (all owners with land contiguous to the property to be subdivided, not taking into account roads or streets). Notice shall include a map of the subdivision and proof of service shall be required. The commission shall recommend to approve, conditionally approve or disapprove the preliminary plat within sixty (60) calendar days after the date of the regular meeting at which the preliminary plat is first formally presented, unless an extension of time is agreed upon by all concerned. The reasons for such action by the commission shall be stated in writing, a copy of which shall be sent to the subdivider.
The City Council, upon receiving the recommendation of the commission, shall approve or disapprove the plat within sixty (60) days. One copy of the approved preliminary plat will be kept on file for public examination at the Office of the City Clerk. Approval of the preliminary plat shall be valid for a period of one calendar year, unless an extension of time is applied for and granted by the City. (Ord. 311 § 1, 1999)
