§ 34.10 COUNTY CLERK RECORD PERPETUATION FUND; DISBURSEMENT OF LATE PAYMENT FEES.
   (A)   Pursuant to House Enrolled Act 1130, Pub. L. No. 183-2001, the County Clerk Record Perpetuation Fund is hereby established.
   (B)   The Fund is to be maintained by the County Auditor.
   (C)   The $2 document storage fee and the $2 automated record keeping fee collected by the Clerk for all state infractions, ordinance violations, criminal misdemeanors, felonies, delinquencies, CHINS, paternities, small claims, probate and civil actions filed through the County Clerk’s Office shall be transferred to the County Clerk Record Perpetuation Fund. Sums maintained in this Fund shall not revert to the County General Fund at the conclusion of the calender year, but shall remain in the designated Clerk Record Perpetuation Fund.
   (D)   The funds shall be used for the purpose of record keeping and record perpetuation in the County Clerk’s Office.
   (E)   All funds collected by the Clerk for purposes of preparing fax copies of documents shall be deposited in the County Clerk Record Perpetuation Fund.
   (F)   The Auditor is authorized to deposit all fax copy fees collected from January 1, 2001 to present in the Record Perpetuation Fund as established herein.
   (G)   The County Commissioners hereby direct the County Auditor to deposit 40% of the late payment fees collected under I.C. 33-19-6-20 in the County Clerk Record Perpetuation Fund established under I.C. 33-19-6-1.5 and 60% of the late payment fees collected under I.C. 33-19-6-20 in the County General Fund. This division applies to late payment fees distributed to the County Auditor after August 31, 2001.
