§ 51.63 ONSITE SYSTEM PERMIT AND INSPECTION FEES.
   (A)   Definitions. As used in this section:
      COMMERCIAL ONSITE SEWAGE DISPOSAL SYSTEM or ONSITE SEWAGE DISPOSAL SYSTEM (OSDS) means all equipment and devices necessary for proper conduction, collection, storage, treatment, and onsite disposal of sewage from other than one-family or two-family dwellings, except where such dwellings are connected to a cluster system. However, an onsite sewage system serving two single-family dwellings on the same property, with a combined daily design flow (DDF) of less than or equal to 750 gallons per day, is a residential onsite sewage system, not a commercial onsite sewage system. Included within, but not limited to, the scope of this definition are building sewers, grease traps, septic tanks, dosing tanks, absorption fields, perimeter drains, vault privies, and temporary sewage holding tanks serving such facilities as the following:
         (a)   Apartment buildings;
         (b)   Campgrounds;
         (c)   Churches;
         (d)   Commercial establishments;
         (e)   Condominiums;
         (f)   Medical facilities;
         (g)   Mobile home parks;
         (h)   Motels;
         (i)   Office buildings;
         (j)   Restaurants; and
         (k)   Schools.
      COMMERCIAL ONSITE SEWAGE SYSTEM PERMIT. A permit for the installation of a commercial onsite sewage system.
      COMMERCIAL ONSITE SEWAGE SYSTEM REPAIR PERMIT. A permit for the installation of a commercial onsite sewage system repair.
      COMMERCIAL ONSITE SYSTEM REPLACEMENT PERMIT. A permit for the installation of a commercial onsite sewage system replacement.
      DISPOSAL CONNECTION APPLICATION FEE. The fee for department staff to verify arrangements for a sanitary sewer connection has been secured by the applicant as per BC Ordinance 3-1997.
      EXISTING ONSITE SYSTEM PERFORMANCE REVIEW. The review of an existing onsite sewage disposal system (OSDS), at the request of the applicant, for its ability to meet the Rules and Regulations of Indiana and to comply with the requirements of a Regional Sewer District or similar agency.
      INITIAL SITE VISIT FOR ONSITE SYSTEM INSTALLATION REVIEW. The initial site visit request by an applicant for the installation of a new, repair, or replacement onsite sewage disposal system. This term shall also apply for the initial site visit request for verification that a proposed outbuilding or residential or commercial expansion location does not interfere with the existing onsite system.
      ONSITE SEWAGE DISPOSAL INSTALLER. Any person engaged in the construction, installation, repair, or replacement of any component of an onsite sewage disposal system (OSDS).
      ONSITE SEWAGE DISPOSAL SYSTEM (OSDS) REPAIR. The repair or replacement of any OSDS component other than the replacement or expansion of a soil absorption field.
      ONSITE SEWAGE DISPOSAL SYSTEM (OSDS) REPLACEMENT. The replacement or expansion of a soil absorption field.
      REGISTERED ONSITE SEWAGE DISPOSAL INSTALLER. An onsite sewage disposal installer who has completed an application and has passed a written proficiency test as administered by the department.
      REGISTERED ONSITE SEWAGE DISPOSAL INSTALLER ANNUAL FEE. The annual fee for a registered onsite sewage disposal installer starting on January 1 of the year of registration and ending on December 31 of the year of registration.
      RESIDENTIAL ONSITE SEWAGE DISPOSAL SYSTEM or ONSITE SEWAGE DISPOSAL SYSTEM (OSDS). All equipment and devices necessary for proper conduction, collection, storage, treatment, and onsite disposal of sewage from:
         (a)   A one- or two-family dwelling;
         (b)   A residential outbuilding; or
         (c)   Two single-family dwellings on the same property with a combined daily design flow (DDF) of less than or equal to 750 gallons per day. The term includes, but is not limited to, residential sewers, septic tanks, soil absorption systems, temporary sewage holding tanks, and sanitary vault privies.
      RESIDENTIAL ONSITE SEWAGE SYSTEM PERMIT. A permit for the installation of a residential onsite sewage system.
      RESIDENTIAL ONSITE SEWAGE SYSTEM REPAIR PERMIT. A permit for the installation of a residential onsite sewage system repair.
      RESIDENTIAL ONSITE SEWAGE SYSTEM REPLACEMENT PERMIT. A permit for the installation of a residential onsite sewage system replacement.
   (B)   Fees.
      (1)   $200 - Residential Onsite System Permit.
      (2)   $200 - Commercial Onsite System Permit.
      (3)   $100 - Residential Onsite System Repair Permits.
      (4)   $100 - Residential Onsite System Replacement Permits.
      (5)   $200 - Commercial Onsite System Repair Permits.
      (6)   $200 - Commercial Onsite System Replacement Permit.
      (7)   $75 - Registered Onsite Installer Annual Fee.
      (8)   $25 - Disposal Connection Application Fee.
      (9)   $25 - Initial Site Visit for Onsite System Installation Review.
      (10)   $200 - Existing Onsite System Performance Review.
   (C)   Unconstitutionality clause. Should any section, paragraph, sentence, clause or phrase of this section be declared unconstitutional or invalid for any reason, the remainder of this section shall not be affected thereby. All ordinances and parts of ordinances in conflict with this section are hereby repealed, and this section shall be in full force and effect after its adoption and publication as provided by law.
