§ 153.02 VIOLATIONS AS COMMON NUISANCE.
   (A)   Pursuant to I.C. 36-7-4-1012, any structure erected, raised, or converted, or land or premises used, in violation of the Dearborn County Zoning Ordinance and/or the Dearborn County Subdivision Control Ordinance is a common nuisance and the owner or possessor of the structure, land, or premises is liable for maintaining a common nuisance.
   (B)   The County Auditor and/or the attorney representing the County Planning & Zoning Department may initiate a cause of action in any court in the county having jurisdiction and seek any and all remedies outlined in I.C. 36-1-6-4 in an effort to have the common nuisance rectified.
