(A) There is hereby established a Laboratory Services Fund as part of the annual budget of the Dearborn County Prosecutor's Office;
(B) Monies collected from criminal defendants, upon conviction, for blood sample testing shall be deposited into the Laboratory Services Fund. The amount to be paid by the criminal defendant shall be determined by the Judge of the Dearborn Circuit and/or Superior Courts at the time the criminal defendant is sentenced;
(C) Grant monies awarded to the Dearborn County Prosecutor's Office for drug testing shall also be deposited into the Laboratory Services Fund;
(D) Any costs of blood draw testing shall be paid out of the Laboratory Services Fund by the Dearborn County Prosecutor's Office; and
(E) The Laboratory Services Fund is a special non-reverting fund to be available for expenditure by the Dearborn County Prosecutor's Office in accordance with this section.
