(A) Upon adoption of this chapter, no person shall construct, install, replace, alter, or repair any part of an OSDS without being registered with the Dearborn County Health Department.
(B) Any person engaged in the construction of OSDS in Dearborn County shall be knowledgeable and capable of following all laws, rules, and regulations of both the State of Indiana and Dearborn County governing OSDS during all phases of construction.
(C) Any person engaged in the construction, installation, replacement, alteration, or repair of OSDS in Dearborn County shall be registered as an OSDS installer with the Dearborn County Health Department. Registration shall consist of, but is not limited to, the following:
(1) A completed application for registration with payment of the application fee;
(2) An application fee as established by ordinance of the Dearborn County Council;
(3) Passing a written proficiency examination conducted by the Dearborn County Health Department;
(a) The examination shall be in different parts; gravity feed OSDS, flood dose OSDS, mound type OSDS, or types of systems as may be approved by the Indiana State Department of Health;
(b) An applicant may take the written examination on any or all different parts;
(c) The examination shall be reviewed from time to time to determine applicability to current laws, rules, regulations, and ordinances. A score of 80% or higher on each part will be considered passing;
(d) An applicant shall be registered for the installation of OSDS in accordance with successful completion of examination parameters;
(e) When taking a written examination is not feasible due to language, reading, or other difficulties, a verbal (oral) examination may be permissible;
(f) If an applicant fails to pass any part of the examination, the applicant may re-apply for registration no earlier than one month following the failed examination.
(D) Registration issued hereunder shall be valid for a term of one year beginning January 1 and expiring December 31 of the same year, and shall be renewed annually. The registration shall bear the name, address, associated firm or company where applicable, and the expiration date.
(E) An OSDS installer may supervise other construction workers as necessary to assist in the installation of an OSDS.
(F) An OSDS installer shall be on the site at all times during the construction, installation, replacement or repair of an OSDS.
(G) Registrations issued hereunder shall not be transferable.
(H) Registrations may be renewed without re-examination if the applicant can provide documentation of attendance at Indiana State Department of Health or Dearborn County Health Department meetings dealing with the type of registration renewal being sought.
(I) Applicants for OSDS installer registration unable to provide documentation, as noted above, must successfully complete the examination for that portion of renewal being sought.
(J) The OSDS installer shall maintain his or her possession of a copy of the certification at all times when constructing, installing, replacing, or repairing any portion of an OSDS located in Dearborn County.
(K) A property owner wishing to construct, install, replace, or otherwise work on the OSDS serving his or her property shall be required to demonstrate knowledge of the applicable laws, rules, and regulations by successful completion of the proficiency examination conducted by the Dearborn County Health Department. Application fees for these purposes shall be waived.
