§ 51.16 PERMIT REQUIREMENTS.
   (A)   Before commencement of construction of any private residence or business building where a private sewage disposal system is proposed, the owner or the agent of the owner shall first obtain a written permit signed by the Health Officer. The application for such a permit shall be made on a form provided by the Dearborn County Health Department. Such application shall be supplemented by any plans, specifications and other information as may be deemed necessary by the Health Officer. The plan shall also show the following:
      (1)   Location of proposed sewage disposal system or changes to existing system;
      (2)   Location of any existing or proposed source of water supply and water service lines on the subject property; and
      (3)   Location of water supply sources, water service lines, sewage disposal systems within 300 feet of the subject property (for commercial sewage disposal systems) or 200 feet of the subject property (for residential sewage disposal systems).
   (B)   The fee for the sewage disposal system shall be in accordance with the most recent fee ordinance as established by the Dearborn County Council.
   (C)   If the sewage disposal system has not been constructed, installed, altered or extended within one year from the date of issuance, the permit shall automatically expire.
   (D)   The Dearborn County Board of Health shall deny a permit if the information on the application is incomplete, inaccurate or indicates that the provisions of the Indiana Code, the Indiana Administrative Code, and/or chapter cannot be met.
   (E)   A permit issued for a residential or commercial sewage disposal system shall not become effective until the installation is completed in compliance with the standards set forth in the Indiana Code, the Indiana Administrative Code, and/or this chapter, its incorporated references and in the proposed design of the system.
   (F)   The permit shall be posted in a conspicuous place at or near the building where the sewage disposal system is under construction. The permit shall be plainly visible from the public thoroughfare serving the building.
