§ 152.17 BASIS FOR ESTABLISHING REGULATORY FLOOD DATA.
   (A)   This chapter's protection standard is the regulatory flood.
      (1)   The best available regulatory flood data is listed below.
      (2)   Whenever a party disagrees with the best available data, the party submitting the detailed engineering study needs to replace existing data with better data, and submit it to the Indiana Department of Natural Resources for review and approval.
   (B)   The regulatory flood elevation, floodway and fringe limits for the studied special flood hazard areas (SFHAs) of Whitewater River and Laughery Creek, Wilson Creek, Logan Creek, and Tanners Creek shall be as delineated on the 100-year-flood profiles in the Flood Insurance Study of the county dated March 16, 1982, and the corresponding Flood Boundary and Floodway Map (FBFM) dated September 16, 1982, as well as any future updates, amendments or revisions prepared by FEMA with the most recent date.
   (C)   (1)   The regulatory flood elevation for the studied SFHA of the Ohio River shall be as delineated on the 100-year-flood profiles in the Flood Insurance Study of the county dated March 16, 1982, and the corresponding FBFM dated September 16, 1982, as well as any future updates, amendments or revisions prepared by FEMA with the most recent date.
      (2)   The regulatory floodway and fringe limits for the studied SFHA of the Ohio River shall be according to the best data available as provided by the Indiana Department of Natural Resources.
   (D)   The regulatory flood elevation, floodway and fringe limits for each of the remaining SFHAs delineated as an “A Zone” on the FIRM of the county shall be according to the best data available as provided by the Indiana Department of Natural Resources.
   (E)   The regulatory flood elevation, floodway and fringe limits for the studied SFHA of Whitewater River shall be as delineated on the 100-year-flood profiles in the Flood Insurance Study of the Town of West Harrison dated July 17, 1984, and the corresponding FBFM dated January 17, 1985, as well as any future updates, amendments or revisions prepared by FEMA with the most recent date.
