§ 31.15 ESTABLISHMENT.
   (A)   In accordance with and by the authority of a resolution of the County Council on December 7, 1972, as authorized by enabling act of Acts of the State Legislature of 1961, Chapter 285, S.1, and as amended and/or supplemented by state code and common law, where applicable, and by appointment of the original serving Merit Board members by the County Sheriff, the County Sheriff’s Merit Board is hereby created.
   (B)   It is the intent of the County Merit Board to comply with all state code, common law, and/or any federal provisions as may apply. If any conflicts or discrepancies arise between or among any citeable legal authorities and the Rules and Regulations of the County Sheriff’s Merit Board, then, in that event, the Rules and Regulations of the County Sheriff’s Merit Board shall be construed, conformed and/or amended according to the referenced legal authority.

Editor’s note:
   The Sheriff’s Merit Board was established by a resolution passed 12-7-72. Being advised that there might not be an ordinance establishing The Sheriff’s Merit Board, the County Council passed two ordinances, CC 3-2000 and CC 4-2000, to ratify its establishment. BC 2000-9 contains the current revised and adopted rules and regulations of the Board.
