§ 110.22 PERMIT REQUIREMENTS.
   (A)   It shall be unlawful for any person to operate a retail food store, mobile food store, or temporary retail food store in the county without a valid permit from the Health Officer. Such permit shall be posted in a conspicuous place in the establishment. The permit for a retail food store and mobile retail food store shall be for a term of one year and must be renewed annually. The permit for a temporary retail food store shall be for a term of one continuous operation not to exceed 14 days duration. Any permit issued by the Health Officer will contain the name and address of the establishment, the person to whom the permit is granted, and any other pertinent information as may be required by the Health Officer.
   (B)   A separate permit shall be required for each retail food store, mobile retail food store, or temporary retail food store operated or to be operated by any person. A permit issued under this subchapter is not transferable.
   (C)   A permit shall be issued to any person upon application, after inspection and approval by the Health Officer, provided that the establishment complies with all the applicable provisions of this subchapter.
   (D)   A fee of $15 each, or in an amount as established by the County Board of Health, shall be paid by the applicant to the County Health Officer at the time a retail food store or mobile retail food store permit is issued. Such fee shall revert to the County Health Fund.
   (E)   Any person who desires to operate a temporary retail food store in the county shall secure a permit from the Health Officer for such establishment. A fee of $3 each, or in an amount as established by the County Board of Health, shall be paid by the applicant at the time said permit is issued. Such fee shall revert to the County Health Fund.
   (F)   Permits or permit renewals shall not be denied or revoked on arbitrary or capricious grounds.
   (G)   No permit shall be required and no fee shall be paid for a retail food store, mobile retail food store, or temporary retail food store, which is operated by religious, educational or charitable organizations.
