For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ADULTERATED AND MISBRANDED. The meanings as provided in IAC 16-1-29.
BOARD OF HEALTH. The Board of Health having jurisdiction in Dearborn County, State of Indiana.
EMPLOYEE. The permit holder, individual having supervisory or management duties, person on the payroll, family member, volunteer, person performing work under contractual agreement, or any other person working in a food store.
FOOD. Any raw, cooked, or processed edible substance or beverage or ingredient used or intended for use or for sale in whole or in part for human consumption.
HEALTH OFFICER. The appointed Health Officer, the acting Health Officer, or the Health Officer's authorized representative.
HERMETICALLY SEALED CONTAINER. A container which is designed and intended to be secure against the entry of microorganisms and to maintain the commercial sterility of its contents after processing.
MOBILE RETAIL FOOD STORE. Any retail food store capable of being readily moved from location to location, one without a fixed location.
POTENTIALLY HAZARDOUS FOODS. Any food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish, edible crustacea, or other ingredients, including synthetic ingredients, and which is in a form capable of supporting rapid and progressive growth of infectious or toxigenic micro-organisms. The term does not include: clean, whole, uncracked, odor-free shell eggs; or food products that have a pH level of 4.6 or below, or a water activity (aw) value of 0.85 or less under standard conditions; or food products in hermetically sealed containers processed to prevent spoilage.
RETAIL FOOD STORE. Any establishment or section of an establishment where food or food products are offered to the consumer and intended for off premise consumption. The term includes delicatessens that offer prepared food in bulk quantities only. The term does not include establishments which handle only prepackaged, non-potentially hazardous foods; roadside markets that offer only fresh fruits and fresh vegetables for sale; food service establishments; or food and beverage vending machines.
TEMPORARY RETAIL FOOD STORE. Any retail food store which operates for a period not to exceed 14 days, in connection with a fair, carnival, public exhibition, or similar transitory gathering.
UNWHOLESOME. Detrimental to physical well being, unsound condition, filthy, adulterated or otherwise unsuitable for human consumption.
