§ 94.98 ENFORCEMENT.
   (A)   Erosion control inspection will be performed with each building inspection.
   (B)   (1)   A written warning in the form of a yellow “Rejected” tag identifying the corrective time frame will be given with the first violation.
      (2)   The yellow "Rejected" tag will have the phone number of the County SWCD for technical assistance.
   (C)   A SWCD representative will investigate the incident at the site after being contacted by the property owner or the property owner's agent.
      (1)   The SWCD representative will make corrective recommendations to the property owner or the property owner's agent.
      (2)   The SWCD representative will send a copies of the recommendations to the Building Commissioner and to the property owner or the property owner's agent.
   (D)   The Building Commissioner, or his or her representative, will complete a follow up investigation after the “Rejected” tag has expired, or after he or she has been contacted by the property owner or the property owner's agent, whichever comes first.
      (1)   At this follow up investigation, the Building Commissioner, or his or her representative, will determine compliance or non-compliance.
      (2)   If the site is found to be in compliance, no further enforcement action will be taken.
   (E)   If after the second site inspection continued non-compliance is determined, the Building Commissioner will issue a non-compliance citation to the property owner.
   (F)   Appeal of the revocation of an improvement location permit and civil penalties may be in accordance with the county building ordinance.
