§ 91.18 REQUIREMENTS AND SPECIFICATIONS.
   (A)   The requirements and specifications of this program shall be as follows:
      (1)   Requirements.
         (a)   The roadway or section thereof to be paved shall begin at either the intersection with another county road or at the end of a previously asphalted roadway.
         (b)   Chip and seal shall not be permitted.
         (c)   The asphalt shall be a minimum of two inches (220#/sys) thick.
         (d)   Where possible the roadway shall be 18 feet minimum width as paved with an existing gravel base of 19 feet wide and eight inches thick.
         (e)   The minimum length of improvement allowed is 100 feet, unless at the end of an existing roadway.
         (f)   The minimum length to justify the use of a paver is 850 feet.
         (g)   Platted subdivisions shall be done in their entirety as platted.
      (2)   Acceptance.
         (a)   Upon receipt of an accurate and complete Form A-II (attached to BC Ord. 6-1995 marked exhibit A and made a part hereof), the County Engineer will:
            1.   Make a recommendation to the Commissioners as to the requested project, including a preliminary invoice. The Commissioners will then pass a resolution at a regularly scheduled meeting as to the acceptability of the request and authorize issuance of a final invoice.
            2.   Send a letter to the applicant indicating the acceptability of the project to the Commissioners and if approved by the Commissioners, include a final invoice for the estimated amount of the project.
         (b)   Within 30 days of receipt of the required check, the applicant shall be notified of the status of the request. If approved, an approximate date will be given for the project. This date is very tentative and subject to change.
         (c)   A certified check or cashier's check for the amount as indicated by the County Engineer for the cost to the Highway Department for the estimated quantity of asphalt and paver rental shall be submitted prior to final acceptance by the Commissioners.
         (d)   If the request is formally approved and a final invoice is issued, no additional cost will be passed to the applicant due to price increases or errors in estimating, regardless of the time required to schedule the project.
         (e)   The project shall be scheduled as quickly as possible; however, as the Highway Department is completing the work with its own forces to reduce cost to the applicant, no guarantee is offered that the project can be completed sooner than approximately one year after acceptance.
         (f)   The applicant should be aware that should funding become available in the future for similar projects, no refund will be forthcoming; however, no other projects of similar nature shall be scheduled ahead of a previously approved project.
         (g)   Projects shall be scheduled in the order of approval. Formal approval by the Commissioners shall not precede receipt of the money required for the project.
      (3)   Construction.
         (a)   The Highway Department shall make all improvements as may be required before paving begins. These improvements shall be as determined by the Highway Department and may include without limitation the following: replacement/placement of pipes, berming, addition of base material, grading and crowning of existing base material, ditching, seeding, mulching.
            1.   If a driveway presently has a pipe which is inoperative or at an incorrect grade for a proposed ditch; the Highway Department will ditch through the driveway salvaging the existing pipe if possible. If not possible to salvage the pipe the property owner shall be responsible for acquiring a new one. Replacement of driveway material is limited to asphalt or gravel. Concrete may be placed by the property owner provided it meets the elevation of the edge of pavement and is not raised.
            2.   If an existing driveway has no pipe but one is required or if the existing pipe is of inadequate size for existing drainage, the Highway Department will place the pipe; however, the property owner must supply the pipe.
         (b)   The Highway Department shall schedule and supervise the paving operation, including hauling and placing of material. The decision as to method of paving shall be that of the County Highway Supervisor. Asphalt may be placed utilizing a road grader, asphalt spreader or paver the option being that of the County Highway Supervisor.
         (c)   A primer coat or tack coat shall be required on all projects. The cost of the liquid asphalt shall be the responsibility of the applicant and shall be included on the Highway Department invoice.
         (d)   The cost of the paver rental is also to be included on the final invoice.
   (B)   The county reserves the right to vary these requirements on a job to job basis in order to provide a more safe and functional highway system.
