§ 37.18 OBSTRUCTION OF DRAIN OR NATURAL SURFACE OF WATERCOURSE.
   (A)   Pursuant to I.C.36-9-27.4-9, a person may file a petition under this chapter asking the Dearborn County Drainage Board to remove, or authorize or order the removal of, an obstruction from a drain or natural surface watercourse located outside the person's tract in order to promote better drainage of the person's tract if, upon request, the owner of the land upon which the obstruction is located, does not remove the obstruction.
   (B)   The Dearborn County Board of Commissioners hereby adopts the petition (Request for Investigation) attached and marked as Exhibit A to BC Ord. 2011-011, incorporated by reference as if fully set forth herein. Said petition meets the requirements of I.C. 36-9-27.4-10 and was created for the convenience of the citizens of Dearborn County. Said petition may be picked up in the Dearborn County Surveyor's Office.
   (C)   Pursuant to I.C. 36-9-27.4-11, the Dearborn County Board of Commissioners hereby adopts a filing fee of $50 which is reasonably necessary to defray the expenses incurred by the Drainage Board in processing the petition. Revenue from said filing fees shall be deposited in Account Number             .
