(A) Website internet access. Limited access will be provided for the general public to the Dearborn County GIS through a website via the internet without fee. An administrative committee consisting of the Dearborn County Administrator, Dearborn County Auditor, Dearborn County Surveyor, Dearborn County Recorder, Dearborn County Assessor, and a representative from the Dearborn County Planning and Zoning Department shall recommend from time to time to the Dearborn County Commissioners what information should be provided from the Dearborn County GIS to the general public through the website via the internet without fee. The Dearborn County Commissioners shall act upon such recommendations from time to time and determine what information will be provided from the Dearborn County GIS to the general public through the website via the internet without fee.
(B) Access fees.
(1) For those users desiring additional, greater, or more efficient access to the Dearborn County GIS than is available via the website internet access, Dearborn County will provide the GIS data in the formats and at the fees as detailed in Exhibit A, attached to BC Ord. 2021-008 and incorporated by reference as if fully set forth herein and as may be amended by the Dearborn County Board of Commissioners and the Dearborn County Council from time to time.
(2) Fees must be prepaid to the Dearborn County Planning and Zoning Department by the end user prior to the GIS product or access to the GIS product being provided to the end user. The end user must also accept and agree to the terms of use pertaining to the Dearborn County GIS or the respective Dearborn County GIS product prior to GIS access or the GIS product being provided. In accordance with I.C. 5-14-3-8(j), the fees for the GIS data will be waived for the following uses and users: public agency program support, non-profit activities, journalism, and academic research. Service charges, shipping and handling charges, and media charges will still be imposed upon such uses and users.
(3) The digital data will be delivered in the format in use by Dearborn County staff at the time of delivery. Additional formats may be provided by Dearborn County staff in its discretion.
(C) GIS Perpetuation Fund. Revenue from the GIS service shall be deposited in the GIS Perpetuation Fund, Fund Number 4927. Expenditures from this fund may be used for maintenance and upkeep of the GIS service. This fund shall be perpetual and any balance remaining at the end of the fiscal year is nonreverting. If this fund is terminated by future ordinance, any remaining balance shall be transferred to the Dearborn County general fund.
(D) Terms of use. With the assistance of the Dearborn County Attorney, the Dearborn County Planning and Zoning Department shall develop such disclaimers, usage agreements, license agreements, and other agreements containing the terms of use applicable to the Dearborn County GIS and the data and products it produces which are reasonably necessary to protect the interests of Dearborn County, Indiana. Exceptions to the use of the standard Dearborn County GIS terms of use developed by the Dearborn County Planning and Zoning Department shall be subject to the approval of the Board of Commissioners of Dearborn County, Indiana.
(E) Use of fees. All fees collected pursuant to this section for the Dearborn County GIS shall be distributed to and paid into the Dearborn County GIS Perpetuation Fund in accordance with division (C) above.
(F) GIS Coordinator. Subject to funds being appropriated by the Dearborn County Council, Dearborn County, Indiana may employ a GIS Coordinator or, in the alternative and by agreement executed by the Dearborn County Commissioners, enter into contract(s) with a third party to act as the GIS Coordinator for Dearborn County, Indiana.
