DIVISION 1. PURPOSE, DEFINITIONS, AND APPLICABILITY
The purpose of this article is to regulate the storage of bulk solid material at facilities in the city that store, handle, load, unload, stockpile, or process such bulk solid material.
The city finds that activities associated with these facilities have the potential to create, or contribute to the creation of, fugitive dust and/or debris, and the proliferation of such fugitive dust and/or debris have the potential to create negative impacts on both residents and property. These include, but are not limited to, potential health hazards associated with inhaling fugitive dust and/or, which include pulmonary inflammation, asthma, and fibrosis.
This article prescribes reasonable regulations to minimize fugitive dust and/or debris coming from facilities that store, handle, load, unload, stockpile, or process bulk solid material, including any person that transports materials to, from, or within these lots.
The provisions of this article are authorized by and adopted pursuant to part 55 of the Michigan Natural Resources and Environmental Protection Act, Public Act 451 of 1994, titled “Air Pollution Control,” particularly Sections 5540 and 5542 being MCL 324.5540 and 324.5542.
