The Michigan Regulation and Taxation of Marihuana Act of 2018, has passed with the intent to adopt marijuana (or "marihuana" as it is identified in the legislation) policies that enable taxing, controlling and legalizing marijuana similar to alcohol. The state legislation permits municipalities to completely prohibit or limit the number of marijuana establishments within its boundaries.
It is the intent of this division to prohibit any and all marijuana establishments within the geographic boundaries of the City of Dearborn pursuant to section 6.1 of the Michigan Regulation and Taxation of Marihuana Act of 2018, and to the fullest extent allowed by law.
It is also the intent of this division that all existing Ordinances or parts of Ordinances are to be interpreted as consistent with this Ordinance and State law. Any Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. Nothing in this Ordinance results in any prohibitions otherwise allowed under the Michigan Regulation and Taxation of Marihuana Act, as adopted, or the Michigan Medical Marihuana Act, Initiated Act 1 of 2008, MCI 333.26421 et seq.
