(A) Violation of this chapter shall be punishable as a misdemeanor under the state statutes. In addition, the city may enforce this section by injunctive action or other appropriate civil remedy. Exception, noise violations constitutes a petty misdemeanor, and upon conviction, a fine not to exceed $100.
(2) Violation of § 130.09(D)(1), (D)(3), (D)(4) or (D)(5) of this chapter is punishable as a petty misdemeanor. Upon a third or subsequent violation of § 130.09(D)(1), (D)(3), (D)(4) or (D)(5) of this chapter by the same owner, the violation is punishable as a misdemeanor. Violation of § 130.09(D)(6) of this chapter is punishable as a misdemeanor.
(C) All drug paraphernalia, as defined in § 130.17 of this chapter, are subject to forfeiture, subject to the provisions set forth in state statutes.
