(A) The Fire Department shall consist of the Fire Chief, Assistant Fire Chief and volunteer firefighters.
(B) The Fire Chief and the Assistant Fire Chief shall be appointed by the Mayor with the approval of the City Council pursuant to KRS 83A.080; and may be removed by the Mayor at will.
(C) No person shall be appointed or act as the Fire Chief or Assistant Fire Chief unless such person has taken the oath required by § 228 of the Constitution of the commonwealth, and who has satisfied the qualification requirements of the Kentucky Revised Statutes.
(D) Subject to the executive authority of the Mayor and the rules and regulations promulgated by the volunteer firefighters and approved by the Mayor, the Chief of the Volunteer Fire Department shall be responsible for the organization and operation of the Fire Department; shall supervise, direct and control the equipment of the Fire Department and the volunteer firefighters in their response to fires and the extinguishment thereof and the plans, preparations, procedures, practice and training in regard thereto; and may, as Chief of the Fire Department, perform or cause to be performed all other actions authorized by law, ordinance or regulation.
(E) The compensation of the Volunteer Fire Department Chief and the Assistant Fire Chief shall be in an amount to be established by City Council by ordinance, in accordance with § 31.02 of this code of ordinances.
(F) The Volunteer Fire Department shall operate in accordance with the by-laws developed and adopted by the members and approved by the Mayor.

(A) The Volunteer Fire Department is expressly granted authority to respond to out-of-town fires.
(B) This authority will be restricted to fires which occur within a maximum range of five miles from the nearest city limits or the next Volunteer Fire Department boundary, whichever is closer. It is the specific intent of the city that the Volunteer Fire Department not cross jurisdictional boundaries of another fire department, unless specifically requested by that fire department in an emergency. This area shall include Caldwell County and the No Outlet area. The exception to this limit would be fire runs to Outwood which is mandated by written contract.
(C) The Volunteer Fire Department may respond only to structure and motor vehicle fires, unless in an emergency.
(D) In the event that an emergency should occur which would require the Volunteer Fire Department to respond to a fire beyond the boundaries described above, it shall be the responsibility of the Fire Chief or the Assistant Fire Chief to report, in writing, to the Mayor and to appear before the City Council at the next regularly scheduled Council meeting to answer questions concerning the need to respond beyond the limits set forth above. However, in the event of an emergency situation in which a threat to human life exists, the City Telecommunicator will at his or her discretion dispatch to the scene one or more city fire units regardless of whether or not the emergency exists within the corporate limits of the city (five-mile limit). The Telecommunicator will make his or her decision based on information gained from the caller, and/or emergency, police or ambulance personnel on the scene.
(E) The cost for out-of-town fire runs shall be $500 for structure fires and $250 for vehicle fires. These funds and all funds collected from operation of the Volunteer Fire Department, including any funds currently held in non-authorized accounts, shall be immediately turned in to the City Clerk/Treasurer. All funds received on behalf of the Volunteer Fire Department will be deposited into an appropriate account maintained by the city and labeled accordingly. This income shall be used to supplement the cost of operating the Fire Department. Expenditures of funds by the Volunteer Fire Department from this account shall be reported in the same fashion as required of other departments created under this chapter.

(A) This subchapter creates the City Volunteer Fire Department and assigns the Volunteer Fire Department with the authority for providing fire and emergency services to the citizens of the city.
(B) The Volunteer Fire Department does not have the capability, within its original structure, to provide emergency services to the citizens.
(C) The citizens are entitled to receive emergency medical services and, as such, the Mayor and City Council do hereby create and authorize the existence of the City Emergency Squad, which shall be considered to be a sub-agency of the Volunteer Fire Department.
(D) As a sub-agency of the Volunteer Fire Department, the Volunteer Fire Department is to adopt by-laws for the Emergency Squad and these by-laws are to be approved by the Mayor. The by-laws shall include, as a minimum, the qualifications for membership as a member of the Emergency Squad.
(E) The Emergency Squad shall consist of a Director of Maintenance and a Director of Plans, Operations and Training, as well as such other volunteer members as may seek application for membership and as may meet the approval pursuant to standards to be adopted by the Emergency Squad.
(F) The Emergency Squad shall provide such accountings as may be required by law. Moneys received as a result of the activities of the Emergency Squad shall be deposited with the City Clerk/Treasurer and shall be maintained in a separate account marked on behalf of the Emergency Squad.
(G) Equipment owned and operated by the Emergency Squad shall be transferred to the city who shall assume the responsibility for the maintenance and upkeep of this equipment. The proceeds received for the operation of the Emergency Squad shall be applied toward the cost of maintenance and upkeep.
(H) The Emergency Squad is expressly granted permission to conduct out-of-town emergency runs, so as to provide emergency medical service for the citizens.
