§ 35.096 FIRE CHIEF; ASSISTANT CHIEF; FIREFIGHTERS.
   (A)   The Fire Department shall consist of the Fire Chief, Assistant Fire Chief and volunteer firefighters.
   (B)   The Fire Chief and the Assistant Fire Chief shall be appointed by the Mayor with the approval of the City Council pursuant to KRS 83A.080; and may be removed by the Mayor at will.
   (C)   No person shall be appointed or act as the Fire Chief or Assistant Fire Chief unless such person has taken the oath required by § 228 of the Constitution of the commonwealth, and who has satisfied the qualification requirements of the Kentucky Revised Statutes.
   (D)   Subject to the executive authority of the Mayor and the rules and regulations promulgated by the volunteer firefighters and approved by the Mayor, the Chief of the Volunteer Fire Department shall be responsible for the organization and operation of the Fire Department; shall supervise, direct and control the equipment of the Fire Department and the volunteer firefighters in their response to fires and the extinguishment thereof and the plans, preparations, procedures, practice and training in regard thereto; and may, as Chief of the Fire Department, perform or cause to be performed all other actions authorized by law, ordinance or regulation.
   (E)   The compensation of the Volunteer Fire Department Chief and the Assistant Fire Chief shall be in an amount to be established by City Council by ordinance, in accordance with § 31.02 of this code of ordinances.
   (F)   The Volunteer Fire Department shall operate in accordance with the by-laws developed and adopted by the members and approved by the Mayor.
