§ 95.08 COMMERCIAL ENTERPRISE REGULATIONS AND LICENSING.
   (A)   Any person who has title to, or the right to use, land adjacent to Lake Beshear, and who has a right-of-way to such property which will allow service to guests and customers, may make application to the City Council for a license to use the lake and such part of the 50-foot easement as the application may designate for a commercial enterprise.
   (B)   The City Council may, upon such terms as it deems desirable, issue the applicant a license to operate for profit a commercial marina or dock, or a commercial swimming beach. The applicant shall pay an annual fee for said license in an amount to be set by the City Council by ordinance.
   (C)   The commercial uses which may be licensed shall include, but are not limited to, the erection and construction on the 50-foot easement of improvements such as ramps, tents, camping sites, picnic tables and other picnic facilities, facilities for the sale of bait and similar supplies, camping supplies, boat slips, rental of boats, motors and camp pads; provided, however, that, no commercial facility shall be constructed so as to impede public passage across the 50-foot easement.
   (D)   The application to the City Council for a license for each commercial enterprise on the lake and the 50-foot easement shall expressly offer and agree to hold the city, its officers and employees, harmless from any and all claims by the public which may arise from the operation and use of the commercial enterprise. The city, its officers and employees, shall, in no way, be liable or responsible for injuries, accidents or other misfortunes, if any, arising from the use of Lake Beshear and the 50-foot easement. Before any such license shall be granted, the applicant therefor shall procure at his or her own expense a liability insurance policy, which shall include minimum liability limits of $100,000/$300,000.
