(a) Except as provided in MCL 460.1315 and 460.1317 and as limited in this section, small cell siting is a permitted use and not subject to zoning regulation if it complies with all other sections of this chapter and if:
(1) A utility pole in the right-of-way installed or modified on or after the effective date of this chapter does not exceed forty feet above ground level, unless a taller height is agreed to by the City.
(2) A small cell wireless facility in the right-of-way installed or modified after the effective date of this chapter does not extend more than five feet above a utility pole or wireless support structure on which the small cell wireless facility is colocated.
(b) The City may revoke zoning approval, upon thirty days' notice and an opportunity to cure, if the permitted small cell wireless facilities and any associated wireless support structure fail to meet the requirements of the approval, applicable codes, or applicable zoning requirements.
