(a) Violations. A violation of any of the provisions of this Zoning Code or failure to comply with any of its requirements, including a violation of a condition or safeguard required as a condition for the granting of a variance, an appeal, or a conditional use permit, shall constitute a civil infraction. Whoever violates any of the provisions of this Zoning Code, or fails to comply with any of its requirements, including violations of conditions and safeguards required as conditions for the granting of variances, appeals, or conditional use permits, shall be subject to the penalty provided in Section 202.99
(d) and, in addition, shall pay all costs and expenses involved in the case.
(b) Separate Offenses.
(1) The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent or other person who commits, participates in, assists in or maintains such violation, may each be found guilty of a separate offense and suffer the penalties herein provided.
(2) A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
(c) Other Action. Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation.
(d) Public Nuisance Per Se. Any building or structure which is erected, altered, or converted, or any use of premises or land which is begun or changed, subsequent to the time of passage of this Zoning Code and in violation of any of the provisions thereof, is hereby declared to be a public nuisance per se, and may be abated by order of any court of competent jurisdiction.
(e) Fines; Imprisonment. The owner of any building, structure or premises or part thereof, where any condition in violation of this Zoning Code shall exist or shall be created, and who has assisted knowingly in the commission of such violation, shall be guilty of a separate offense and upon conviction thereof shall be liable to the fines and imprisonment as provided in Section 202.99
(d).
(f) Cumulative Rights and Remedies. The rights and remedies provided herein are cumulative and in addition to any other remedies provided by law.
