1060.03 BUSINESS AND COMMERCIAL ESTABLISHMENT WASTE.
   (a)   Definition. As used in this section:
“Solid waste” means all miscellaneous, non-hazardous waste materials and matter resulting from business operations, general routine property use and maintenance, and physical construction and installations related to general routine property use including garbage, rubbish, waste materials from commercial business operations, and waste materials from the construction or repair of buildings and structures. It also includes animal waste and all rejected food wastes.
   (b)   (1)   It shall be the responsibility of the owner, occupant, tenant, or lessee of any business, professional office, or commercial establishment to arrange for the collection and disposal of any and all solid waste generated in their operations.
      (2)   An exception to this requirement is permitted for non-commercial uses in the C-1 zoning district, including residential uses located above the ground floor (mixed use). These uses may have curbside collection. However, in order to promote the public health, welfare, and safety of the general public while preserving the walkable and pedestrian-friendly character of the downtown area, this exception does not apply to lots with frontage on North Main Street that are bounded to the north by East Third Street and by the railroad tracks to the south.
         A.   In no case shall accumulation of solid waste be placed out for collection prior to noon of the day preceding the designated collection day, and all containers must be taken in prior to noon the following day of scheduled collection.
         B.   Containers shall be leak proof and have functioning lids that shall be kept closed so that the containers' contents are not visible to the public and so that the containers' contents cannot blow, drift, or drop from the containers.
   (c)   The following rules and regulations shall apply to solid waste collection from a business or commercial establishment using a waste disposal container and enclosure:
      (1)   Waste disposal containers shall remain covered at all times.
      (2)   A sufficient number of waste disposal containers shall be required so that no overflowing shall occur.
      (3)   Waste disposal containers shall be kept clean and odor free.
      (4)   All putrescible material shall be in tightly sealed plastic bags before being placed in waste disposal containers.
