§ 93.04 WEEDS, RUBBISH AND GARBAGE.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      GARBAGE. Animal or vegetable waste resulting from the handling, preparing, cooking and consuming of food.
      RUBBISH. Paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery and dust and other similar materials and the residue from the burning of wood, coal, coke and other combustible materials.
      WEEDS. All grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens or agricultural crops.
   (B)   No person or entity shall maintain any lot or acreage located within 100 feet of the boundary of any residential, commercial or professional property in Daviess County but outside the corporate limits of the City of Owensboro on which garbage or rubbish accumulates or excessive amounts of weeds are allowed to grow above ten inches. Any such acreage or lot on which such garbage, rubbish or weeds are allowed to remain for seven consecutive days is declared a public nuisance and dangerous to the health, welfare, safety and convenience of the people in the county.
