§ 130.18 PLACES SMOKING IS NOT REGULATED.
   Notwithstanding any other provisions of this subchapter to the contrary, the following areas shall be exempt from the provision of § 130.17:
   (A)   Private residences, except when used as a childcare, adult day care, or a health care facility;
   (B)   Facilities that do not permit minors under the age of 18 to enter;
   (C)   Hotel and motel rooms that are rented to guests and are designated as smoking rooms;
   (D)   Private clubs; provided, that when such clubs are being used for functions to which persons under the age of 18 are allowed to enter, the prohibitions set out in § 130.17 shall apply; or
   (E)   Independently ventilated enclosed public areas where persons under the age of 18 are not allowed to enter.
