§ 35.01 DEVELOPMENT COMMISSION.
   (A)   The Development Commission shall have three members and shall be appointed as follows: the Commission shall be appointed by the Board of County Commissioners as follows: one of the members shall be selected by the Board of County Commissioners, one shall be appointed by the County Council and one shall be nominated by the Council of the City of Washington.
   (B)   (1)   The Commissioners shall take office upon their appointment, and their term of office shall run the following number of years from February following the original appointment.
         (a)   The Commissioner selected by the Board of County Commissioners for three years.
         (b)   The Commissioner appointed by the County Council, two years.
         (c)   The Commissioner nominated by the Council of the City of Washington, one year.
      (2)   The County Auditor is hereby directed to notify the executive officers required to make selections in governing bodies required to make nominations informing that they have a duty to make selections and shall do so within 15 days after receiving the notice.
      (3)   Each of the selectees and nominees shall be appointed by the appropriate executive officer within two days after receiving the nomination.
   (C)   At the expiration of their respective terms, each of the Commissioners originally appointed, their respective successors shall be selected and nominated before the expiration of the term in the same manner as the original appointee and each succeeding member shall serve for a term of four years.
      (1)   In the event any governing body shall fail to make nomination within the time specified, the executive officer may select and appoint a person without a nomination.
      (2)   The Commission shall have the powers as set and given to it in the Indiana Code.
