(A) Construction of subchapter. This subchapter is not intended to limit or restrict the rights and powers of county government with respect to emergency management. The Commissioners, Emergency Management Director, Emergency Management Advisory Council, and Department of Emergency Management shall have all rights and powers as provided in I.C. 10-14-3. Each provision of this subchapter shall be construed as separate to the end that if any part shall be held invalid for any reason, the remainder shall continue in full force and effect. This subchapter shall be effective upon the date of publication and compliance with applicable legal requirements.
(B) Effect on prior emergency management ordinances. This subchapter is intended to and shall repeal and supersede the existing County Emergency Management Ordinance.
