§ 93.01 FIRE PROTECTION DISTRICT.
   (A)   There has heretofore been presented appropriate petitions to establish the Southeast Daviess Fire Protection District presented to the Board of Commissioners by residents of Reeve Township, Harrison Township and the residents of Alfordsville, all of which petitions are hereby with reference incorporated herein, to-wit: the matter having now been under consideration the Board of Commissioners does now find that it is in the best interest to establish the Southeast Daviess Fire Protection District, which this section shall effectuate pursuant to the appropriate statutes hereinafter set forth, there having been heretofore held a public hearing on the petition pursuant to I.C. 36-8-11-8, and the petitions appearing to be in compliance with the above-referenced statute.
   (B)   This section shall serve the purpose of setting this matter for public hearing pursuant to I.C. 36-8-11-8(c) to determine whether it is in the best public interest pursuant to the statute, and if so deemed, this section shall be passed, but the effective date shall be withheld until January 1, 1991 for budgetary purposes.
   (C)   This section is hereby further to appoint trustees pursuant to I.C. 36-8-11-12. Thereafter, the vacancy shall be filled in compliance with I.C. 36-8-11-12.
   (D)   This section, whenever it shall be passed, shall not be effective until January 1, 1991 for the purpose of effectuating fire protection for the Townships of Reeve, Harrison and the Town of Alfordsville. However, this section will immediately upon passage establish a political subdivision as that entity is described in the state statutes, enabling the Southeast Daviess Fire Protection District to submit an appropriate budget for the taxable year 1991 to the County Council for inclusion along with all other monetary matters considered by the Council with effective taxing capabilities to start January 1, 1991, with the creation of a levee, all pursuant to I.C. 36-8-11-18 and in compliance therewith.
