(A) The Board of Commissioners, after receiving an application, shall establish a coal haul route(s). The coal haul routes established by the Board of Commissioners shall be the only routes in the county highway system that coal trucks with a gross weight of 20,000 pounds or more may travel upon without violating this subchapter.
(B) Each coal haul route so established shall have a maximum speed limit of 45 mph in rural areas, and 35 mph in residential areas. The speed limit is to be effective upon the installation of traffic signs so indicating the speed limit. Any person violating the maximum speed limit for the coal haul routes shall be liable for prosecution under the laws of the state and shall have the same rights, duties and responsibilities as any other motorist on any other highway of this county and state.
