For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
COAL HAUL ROUTE. The specific roads, designated by the Commissioners, that trucks may use in transporting coal.
EQUIPMENT CROSSING. The specific roads, designated by the Commissioners, that may be crossed with mining equipment.
HIGHWAY. Any roadway heretofore designated a part of the county highway system, and shall include the entire right-of-way of the highway.
MINE THROUGH. The specific roads, designated by the Commissioners, that may be closed, removed, the coal mined and the road restored.
MINERAL. Coal, clay, shale or coal by-products such as bottom ash, fly ash and the like.
OPERATOR. A person engaged in carrying on surface mining operations.
PERSON. Includes any individual, partnership, corporation, firm or association.
PIT. A tract of land from which the overburden has been removed or is being removed, and where minerals are being produced in the raw state.
RUN AROUND. A temporary road constructed by the coal company to bypass a "mine through".
SURFACE MINING. All or any part of the process followed in the production of minerals by uncovering therefrom the overburden above the mineral deposits, or the removing of overburden for the purpose of determining the location, quality or quantity of a mineral deposit.
TRUCK. Any self-propelled motor vehicle with a gross weight of 20,000 pounds or over, that is used to transport coal.
